TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIJILAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.

This includes, without limitation, damages for loss of data, loss of profits, business interruption, or any other commercial or economic loss — even if Vijilan has been advised of the possibility of such damages. To the extent any liability of Vijilan is established, its total aggregate liability arising from these Terms or your use of the Site shall not exceed USD $100. Some jurisdictions do not permit certain of these exclusions; there, the limitations apply only to the fullest extent permitted by law. Nothing in these Terms limits liability for fraud, intentional misconduct, or any liability that cannot be excluded under mandatory law.

All content on the Site — text, graphics, logos, product names, and software — is owned by or licensed to Vijilan Security, LLC and protected by applicable intellectual property law. Nothing on the Site transfers any ownership rights to you. Your use of the Site is also governed by our Privacy Notice, incorporated into these Terms by reference. Any dispute over privacy is subject to these Terms, including the limitation of liability and governing-law provisions.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. We encourage you to contact us first at legal@vijilan.com to resolve any concern informally before pursuing formal proceedings. Nothing in these Terms affects any mandatory rights you may have under the laws of your jurisdiction.

We may update these Terms at any time by posting a revised version on the Site with an updated date. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

• Severability — If any provision is found unenforceable, the remaining provisions remain in full effect.
• No waiver — Failure to enforce any provision does not waive future enforcement rights.
• Entire agreement — These Terms and the Privacy Notice are the complete agreement between you and Vijilan with respect to use of the Site, and do not modify any separate service agreement.
• Language — These Terms are written in English; in the event of conflict with a translation, the English version governs.
